{"id":13825,"date":"2023-12-31T09:55:41","date_gmt":"2023-12-31T14:55:41","guid":{"rendered":"https:\/\/freethepeople.org\/?p=13825"},"modified":"2024-11-22T15:17:55","modified_gmt":"2024-11-22T20:17:55","slug":"justice-produced-best","status":"publish","type":"post","link":"https:\/\/freethepeople.org\/justice-produced-best\/","title":{"rendered":"Justice, Produced Best"},"content":{"rendered":"<blockquote><p>The best system for justice is supervision of justice producers by customers.<\/p><\/blockquote>\n<p>Justice is produced most of all by high-quality individual <a href=\"https:\/\/www.scribd.com\/read\/409505733\/Christian-Formation-Integrating-Theology-and-Human-Development\" rel=\"noopener\" target=\"_blank\">moral development<\/a>. The key producers are parents, community contacts, schoolteachers, writers, and religious teachers.<\/p>\n<p>Some individuals for some time are inadequately morally developed and pose a threat of harm to others. The immediate, direct defense is <a href=\"https:\/\/archive.org\/details\/moregunslesscrim00lott\/page\/158\/mode\/2up\" rel=\"noopener\" target=\"_blank\">self-produced justice<\/a>. This can also defend others. A slower, indirect defense is other-produced justice.<\/p>\n<p>Other-produced justice is produced on specific cases for specific individuals, for prices that are paid by all insured group members. Justice increases when justice insurers help insured group members proactively take precautions that prevent losses or <a href=\"https:\/\/web.archive.org\/web\/20070705065336\/http:\/www.fmglobal.com\/pdfs\/bestreview.pdf\" rel=\"noopener\" target=\"_blank\">limit losses<\/a>. Precautions that work include <a href=\"https:\/\/whatworks.site\/initial-property-rights\/\" rel=\"noopener\" target=\"_blank\">arming<\/a> and training to self-produce justice on demand.<\/p>\n<p>Justice-production systems rely on contractual standards:<\/p>\n<ul>\n<li>Contractual standards should define rules and sanctions that apply equally to all and are minimal and comprehensible. Such contractual standards would be produced if powers were duly <a href=\"https:\/\/freethepeople.org\/separate-powers-automatically-using-simple-rules\/\" rel=\"noopener\" target=\"_blank\">separated<\/a>, and various powers were <a href=\"https:\/\/rconstitution.us\/voters-dilemma\/\" rel=\"noopener\" target=\"_blank\">adequately incentivized<\/a> to provide in-process checks and remedies.<\/li>\n<li>Suitable process checks and remedies include regular, traceable, <a href=\"https:\/\/rconstitution.us\/zero-tolerance-for-election-manner-violations\/\" rel=\"noopener\" target=\"_blank\">untainted elections<\/a> of representatives; documented debates; <a href=\"https:\/\/dailycaller.com\/2023\/01\/09\/anthony-roll-call-votes-are-the-republicans-path-to-building-a-larger-constitutionalist-gop-majority\/\" rel=\"noopener\" target=\"_blank\">documented votes<\/a>; <a href=\"https:\/\/www.americanthinker.com\/articles\/2019\/05\/george_washingtons_error_and_the_corruption_of_banking.html\" rel=\"noopener\" target=\"_blank\">vetoes<\/a>; veto overrides; appeals on cases; pardons of convictions; <a href=\"https:\/\/rconstitution.us\/constitutional-impeachment-is-loss-prevention\/\" rel=\"noopener\" target=\"_blank\">summary impeachments<\/a> of process violators; and <a href=\"https:\/\/rconstitution.us\/on-the-reading-of-old-constitutions\/\" rel=\"noopener\" target=\"_blank\">non-execution of rules and sanctions<\/a> if contractual processes weren\u2019t followed or if a rule or sanction would unduly violate an individual\u2019s <a href=\"https:\/\/claremontreviewofbooks.com\/digital\/we-have-forgotten-what-the-founders-knew\/\" rel=\"noopener\" target=\"_blank\">unalienable rights<\/a>.<\/li>\n<\/ul>\n<p>Given contractual rules and sanctions, violations are prosecuted by victims\u2019 agents. In principle, victims, which include crime victims\u2019 family members, might desire unjustly-differing intensities of investigation and punishment. But in practice, no third-party supervision system would robustly bring to bear the same consuming interest that victims would bring if they were prosecutors\u2019 customers. People who are victims in one case would know they could be accused in other cases. Their overall interests would lead them to choose competent, just police, investigators, prosecutors, judges, and jailers.<\/p>\n<p>A prosecutor should always press only supportable, apparently-true charges, never unsupportable or clearly-untrue charges. At times, more evidence than not will indicate that a prosecutor has pressed, or has threatened to press, unsupportable or <a href=\"https:\/\/amgreatness.com\/2021\/04\/13\/abolish-the-plea-deal\/\" rel=\"noopener\" target=\"_blank\">clearly-untrue charges<\/a>. Whenever this is the case, individuals\u2019 representatives should eliminate the credible threat that this prosecutor poses to future individuals by summarily impeaching the prosecutor and removing his privilege to ever <a href=\"https:\/\/scholarship.richmond.edu\/cgi\/viewcontent.cgi?article=2425&#038;context=lawreview#page=2\" rel=\"noopener\" target=\"_blank\">act as an agent<\/a> exercising individuals\u2019 <a href=\"https:\/\/www.heritage.org\/constitution\/#!\/amendments\/10\/essays\/163\/reserved-powers-of-the-states\" rel=\"noopener\" target=\"_blank\">delegated powers<\/a>.<\/p>\n<p>Judges must ensure that a person who faces a criminal punishment receives due process. Due process includes <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/5\/essays\/148\/double-jeopardy\" rel=\"noopener\" target=\"_blank\">only one jeopardy<\/a> for a given alleged incident, <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/4\/essays\/145\/warrant-clause\" rel=\"noopener\" target=\"_blank\">warrants<\/a> for searches and seizures, <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/158\/right-to-counsel-clause\" rel=\"noopener\" target=\"_blank\">defense counsel<\/a>, <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/8\/essays\/204\/excessive-bail\" rel=\"noopener\" target=\"_blank\">not-excessive bail<\/a>, <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/155\/arraignment-clause\" rel=\"noopener\" target=\"_blank\">arraignment<\/a>, a <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/5\/essays\/146\/grand-jury-requirement\" rel=\"noopener\" target=\"_blank\">grand jury<\/a> if a crime is infamous, a <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/152\/speedy-trial-clause\" rel=\"noopener\" target=\"_blank\">speedy<\/a> and <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/153\/public-trial\" rel=\"noopener\" target=\"_blank\">public trial<\/a>, an <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/154\/jury-trial\" rel=\"noopener\" target=\"_blank\">impartial local jury<\/a>, <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/156\/confrontation-clause\" rel=\"noopener\" target=\"_blank\">confrontation<\/a> of adverse witnesses, freedom to <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/6\/essays\/157\/compulsory-process-clause\" rel=\"noopener\" target=\"_blank\">obtain favorable witnesses<\/a>, freedom to <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/5\/essays\/149\/self-incrimination\" rel=\"noopener\" target=\"_blank\">not self-incriminate<\/a>, and freedom from <a href=\"https:\/\/www.heritage.org\/constitution\/amendments\/8\/essays\/161\/cruel-and-unusual-punishment\" rel=\"noopener\" target=\"_blank\">cruel and unusual punishments<\/a>.<\/p>\n<p>A grand jury should be capable of reviewing and augmenting a prosecutor\u2019s evidence and charges. A prosecutor can unjustly over-investigate, overcharge, under-investigate, or undercharge. Every grand jury should be clearly <a href=\"https:\/\/nationallibertyalliance.org\/files\/docs\/DocumentsEssays\/Jury%20Nullification%20Top%20Secret.pdf\" rel=\"noopener\" target=\"_blank\">tasked with evaluating<\/a> all such errors, and should include enough high-functioning members who will <a href=\"https:\/\/dspace2.creighton.edu\/xmlui\/bitstream\/handle\/10504\/40350\/33_33CreightonLRev821(1999-2000).pdf?sequence=1\" rel=\"noopener\" target=\"_blank\">do their part<\/a> when needed to produce justice.<\/p>\n<p>When a judge opines on a case, the process required of a judge should be suitable to deliver the best quality:<\/p>\n<ul>\n<li>Inputs should not be permitted from clerks, from <a href=\"https:\/\/rconstitution.us\/justice-delayed-and-denied\/\" rel=\"noopener\" target=\"_blank\">amici<\/a>, or from judges\u2019 <a href=\"https:\/\/scholarship.law.bu.edu\/cgi\/viewcontent.cgi?article=3554&#038;context=faculty_scholarship#page=2\" rel=\"noopener\" target=\"_blank\">opinions on other cases<\/a>. No person or thing should interfere with the judge, who is the senior lawyer in the case at hand, focusing on the case\u2019s facts and directly interpreting in his own words how the contractual rules and sanctions apply.<\/li>\n<li>Wholly-secret production of actionable law should not be permitted. Before an opinion is considered actionable law on a case, a judge should be required to first publish his draft opinion for <a href=\"https:\/\/www.bing.com\/search?q=cold+eyes+reviews&#038;qs=n&#038;form=QBRE&#038;sp=-1&#038;lq=0&#038;pq=cold+eyes+reviews&#038;sc=14-17&#038;sk=&#038;cvid=6EA8027C5CAA43B0909C756C50457C1E&#038;ghsh=0&#038;ghacc=0&#038;ghpl=\" rel=\"noopener\" target=\"_blank\">outside<\/a> <a href=\"https:\/\/en.wikipedia.org\/wiki\/Technical_peer_review\" rel=\"noopener\" target=\"_blank\">review<\/a>.<\/li>\n<li>Injustice that deprives a person of his unalienable rights should not be permitted to persist on any case. If a compelling counterargument doesn\u2019t surface at first but does surface later, this counterargument should not just relieve accused persons on future cases, this should relieve the accused person on the initial case immediately. Relief should come from any person who has the required knowledge and power, which includes the initial judge, appeals judges, informally non-executing executives, and formally-pardoning executives.<\/li>\n<\/ul>\n<p>On conviction, if possible and if either cost-effective or voluntarily paid for by the insured group members, a convicted person\u2019s moral development should be <a href=\"https:\/\/www.nber.org\/reporter\/2020number1\/benefits-rehabilitative-incarceration\" rel=\"noopener\" target=\"_blank\">continued<\/a> until the person <a href=\"https:\/\/en.wikipedia.org\/wiki\/Life_imprisonment_in_Norway\" rel=\"noopener\" target=\"_blank\">won\u2019t harm others<\/a>. Each incarcerated person can be assigned to his own cell. People who from the start are more morally developed can be <a href=\"https:\/\/www.publicsafety.gc.ca\/lbrr\/archives\/hv%209308%20n34%201981-eng.pdf#page=109\" rel=\"noopener\" target=\"_blank\">helped<\/a> best by segregating them. People can be provided drug treatment, mental-health treatment, schooling, job training, help finding employment, and social support.<\/p>\n<p>If a given person\u2019s moral development can\u2019t continue until the person won\u2019t harm others, the person must be prevented from harming others for a period of time. Such non-rehabilitative incarceration is the best justice that people will know how to produce for some convicted persons.<\/p>\n<p>How should we get justice produced best? That\u2019s simple. In free and voluntary cooperation, producers compete to add value that <a href=\"https:\/\/rconstitution.us\/the-forgotten-customers\/\" rel=\"noopener\" target=\"_blank\">customers<\/a> voluntarily choose. Customers are the best supervisors; under customers\u2019 supervision, producers improve remarkably. This system has remarkably improved the selection and quality of <a href=\"https:\/\/rconstitution.us\/economic-growth-is-a-natural-effect-of-christianity\/\" rel=\"noopener\" target=\"_blank\">all products<\/a> for which it has been used. This system is equally the key to <a href=\"https:\/\/mises.org\/library\/private-law-emerald-isle\" rel=\"noopener\" target=\"_blank\">improving justice production<\/a> by improving teaching, self-produced justice, rules and sanctions, prosecution, grand juries, due process, judging, rehabilitation, and incarceration.<\/p>\n<p>Every case generates highly-motivated victims who, as customers, are concentrated, intimately-informed, highly-motivated interests. Every person benefits when justice is produced best.<\/p>\n<p>To develop producers who produce justice best, the key is to get producers supervised by
