{"id":13312,"date":"2023-06-01T09:55:15","date_gmt":"2023-06-01T13:55:15","guid":{"rendered":"https:\/\/freethepeople.org\/?p=13312"},"modified":"2024-11-22T15:20:12","modified_gmt":"2024-11-22T20:20:12","slug":"oversight-deprives-us-of-legislative-relief","status":"publish","type":"post","link":"https:\/\/freethepeople.org\/oversight-deprives-us-of-legislative-relief\/","title":{"rendered":"Oversight Deprives Us of Legislative Relief"},"content":{"rendered":"<blockquote><p>Legislative relief begins with on-the-record votes for repeals and summary impeachments.<\/p><\/blockquote>\n<p>The new House of Representatives is proceeding with investigations of the coronavirus pandemic, of federal government weaponization against us, and of the Chinese Communist Party.<\/p>\n<p><strong>Legislative Oversight Defies the Constitution<\/strong><\/p>\n<p>At least oversight and investigations are better than passing more unconstitutional legislation, but they too are unconstitutional, and they whitewash other actions that are unconstitutional (and that are far worse).<\/p>\n<p>Oversight and investigations defy the Constitution\u2019s required separation of powers, which vests the executive power solely in <a href=\"https:\/\/rconstitution.us\/the-first-1461-days-of-a-constitutionalist-president\/\" rel=\"noopener\" target=\"_blank\">presidents<\/a>.<\/p>\n<p>Legislators have done these things that they ought not to have done:<\/p>\n<ul>\n<li>Legislators have asserted power to create <a href=\"https:\/\/digitalcommons.nyls.edu\/cgi\/viewcontent.cgi?article=1237&#038;context=fac_articles_chapters#page=2\" rel=\"noopener\" target=\"_blank\">organizational missions<\/a>.<\/li>\n<li>Legislators have asserted power to dictate organizational structures.<\/li>\n<li>Legislators have not just set the overall budget, but also asserted that their line-item budget estimates have power over presidents\u2019 actions.<\/li>\n<li>Legislators have asserted power over hiring.<\/li>\n<li>Legislators have asserted power over procedures.<\/li>\n<li>Legislators have asserted power over firing.<\/li>\n<\/ul>\n<p>Oversight and investigations treat unconstitutional administrative departments, agencies, and other organizations <a href=\"https:\/\/rconstitution.us\/on-the-reading-of-old-constitutions\/\" rel=\"noopener\" target=\"_blank\">as legitimate<\/a>.<\/p>\n<p>Legislators have left undone these things that they ought to have done:<\/p>\n<ul>\n<li>Senators haven\u2019t taken the lead in <a href=\"https:\/\/digitalcommons.law.uw.edu\/cgi\/viewcontent.cgi?article=2271&#038;context=wlr#page=2\" rel=\"noopener\" target=\"_blank\">drafting and revising treaties<\/a>&mdash;which, after all, are supreme law.<\/li>\n<li>Legislators haven\u2019t passed rules-of-engagement cards.<\/li>\n<li>Legislators haven\u2019t <a href=\"https:\/\/rconstitution.us\/limiting-war-through-good-boundaries-secrecy-independence-basing-roe-cards-declarations-enemy-governments-productivity\/\" rel=\"noopener\" target=\"_blank\">deliberated and voted<\/a> either to declare war or to not declare war, which in the latter case would stop wars from being initiated by our government.<\/li>\n<li>Legislators haven\u2019t <a href=\"https:\/\/rconstitution.us\/triage-and-repeal\/\" rel=\"noopener\" target=\"_blank\">repealed<\/a> <a href=\"https:\/\/rconstitution.us\/do-you-support-the-constitution-take-this-quiz-and-see\/\" rel=\"noopener\" target=\"_blank\">unconstitutional statutes<\/a>.<\/li>\n<li>Legislators haven\u2019t passed most laws but instead have left most lawmaking to be done via regulations, guidance, administrative cases, threats, and the like.<\/li>\n<li>Legislators haven\u2019t <a href=\"https:\/\/rconstitution.us\/constitutional-impeachment-is-loss-prevention\/\" rel=\"noopener\" target=\"_blank\">summarily impeached<\/a> government people who have clearly, on the public record, defied the Constitution.<\/li>\n<\/ul>\n<p>Oversight and investigations on defense overlook that legislators haven\u2019t enacted ROE cards, haven\u2019t voted down declarations of war, and, more broadly, haven\u2019t limited governments, which would allow economic growth that would lead enemy government people to <a href=\"https:\/\/whatworks.site\/world-war-ii-victory-resistance-strength\/\" rel=\"noopener\" target=\"_blank\">not attack<\/a>.<\/p>\n<p><strong>Legislative Relief Requires Repeals<\/strong><\/p>\n<p>The <a href=\"https:\/\/www.nytimes.com\/2023\/01\/17\/opinion\/church-committee-republicans.html\" rel=\"noopener\" target=\"_blank\">highly-trumpeted<\/a> <a href=\"https:\/\/www.senate.gov\/about\/powers-procedures\/investigations\/church-committee.htm\" rel=\"noopener\" target=\"_blank\">Church Committee<\/a> on intelligence activities didn\u2019t produce repeals of the agencies responsible, which increasingly deprive us of our freedoms now. Also, the Church Committee didn\u2019t produce impeachments of any agency people or overseers. Besides, any given agency is just the tip of the iceberg of <a href=\"https:\/\/www.forbes.com\/sites\/waynecrews\/2017\/07\/05\/how-many-federal-agencies-exist-we-cant-drain-the-swamp-until-we-know\/\" rel=\"noopener\" target=\"_blank\">perhaps<\/a> <a href=\"https:\/\/www.federalregister.gov\/agencies\" rel=\"noopener\" target=\"_blank\">434 agencies<\/a> and many more <a href=\"https:\/\/rconstitution.us\/socialism-kills-freedom\/#3\" rel=\"noopener\" target=\"_blank\">cronies<\/a>.<\/p>\n<p>The United States Code, Code of Federal Regulations, and national case law are so imposing that reading through them full-time with no holidays would take <a href=\"https:\/\/jamesanthony.us\/papers\/\" rel=\"noopener\" target=\"_blank\">20 years<\/a>.<\/p>\n<p>Almost all this law, including the statutes, is unconstitutional. Nearly all violates the <a href=\"https:\/\/www.jstor.org\/stable\/3329833\" rel=\"noopener\" target=\"_blank\">enumerated powers<\/a>. Most all also violates the constitutional rule to <a href=\"https:\/\/scholarship.law.bu.edu\/cgi\/viewcontent.cgi?article=1685&#038;context=faculty_scholarship\" rel=\"noopener\" target=\"_blank\">not delegate legislative powers<\/a>, or the constitutional rule to <a href=\"https:\/\/www.heritage.org\/political-process\/report\/what-separation-powers-means-constitutional-government\" rel=\"noopener\" target=\"_blank\">separate powers<\/a> so that power will <a href=\"https:\/\/rconstitution.us\/boundaries\/#off-bound\" rel=\"noopener\" target=\"_blank\">offset<\/a> power to limit governments.<\/p>\n<p>The power to overwhelm is the power to <a href=\"https:\/\/www.heritage.org\/constitution\/#!\/amendments\/5\/essays\/150\/due-process-clause\" rel=\"noopener\" target=\"_blank\">deprive<\/a>.<\/p>\n<p>Only legislators can give us repeals as relief from existing unconstitutional statutes. Only legislators can give us impeachments as relief from government people whose past Constitution-defiance shows that given the privilege of future employment, they would be more likely than not to deprive us of property, liberty, or life.<\/p>\n<p>The most long-term freedom would come from these most-urgent <a href=\"https:\/\/rconstitution.us\/contract-to-secure-rights\/\" rel=\"noopener\" target=\"_blank\">seven national-legislative actions<\/a>:<\/p>\n<ol>\n<li>Repeal legal tender laws.<\/li>\n<li>Make emergency power explicitly illegal.<\/li>\n<li>Make generics explicitly unrestricted.<\/li>\n<li>Make explicit that life begins at fertilization.<\/li>\n<li>Make immigration strictly merit-based.<\/li>\n<li>Repeal the DOJ, including the FBI.<\/li>\n<li>Repeal Ukraine support.<\/li>\n<\/ol>\n<p>Even when urgent legislation can\u2019t yet be enacted, the most important action by far is to use constitutional powers to force on-the-record votes. These votes will out the Progressives. Then the Progressives can be challenged, defeated, and <a href=\"https:\/\/dailycaller.com\/2023\/01\/09\/anthony-roll-call-votes-are-the-republicans-path-to-building-a-larger-constitutionalist-gop-majority\/\" rel=\"noopener\" target=\"_blank\">replaced<\/a>, and repeals can be enacted, as soon as possible.<\/p>\n<p>Returning to the new House\u2019s investigations, those pretend actions won\u2019t deliver genuine legislative relief:<\/p>\n<ul>\n<li>On the coronavirus pandemic, this investigation will saturate us with details but change nothing, effectively covering up plenty in plain sight&mdash;and in the process, carefully steering clear of examining past legislatures\u2019 roles, and carefully steering clear of deliberating constitutional legislative relief.\n<p>Genuine relief would come from urgent actions 2 and 3, making <a href=\"https:\/\/rconstitution.us\/if-you-wont-repeal-emergency-powers-you-might-be-a-rino\/\" rel=\"noopener\" target=\"_blank\">emergency power<\/a> explicitly illegal and making <a href=\"https:\/\/rconstitution.us\/private-health\/\" rel=\"noopener\" target=\"_blank\">generics<\/a> explicitly unrestricted.<\/li>\n<li>On federal government weaponization against us, genuine relief would come from urgent action 6, <a href=\"https:\/\/rconstitution.us\/inward-facing-standing-army-must-be-closed-and-repealed\/\" rel=\"noopener\" target=\"_blank\">repealing the DOJ<\/a>.<\/li>\n<li>On the Chinese Communist Party, genuine relief would start with allowing us to strengthen ourselves economically. This would be accomplished by urgent actions 1 and 7, narrowly repealing <a href=\"https:\/\/cdn.mises.org\/18_3_3.pdf\" rel=\"noopener\" target=\"_blank\">legal tender laws<\/a> and Ukraine support, and by more-broadly repealing the administrative state, starting with EPA and OSHA (and their counterparts in the states).\n<p>Administrative agencies bypass the Constitution and the required <a href=\"https:\/\/rconstitution.us\/rsecession-county-region-secessions-to-form-small-r-republican-state-governments\/\" rel=\"noopener\" target=\"_blank\">republican<\/a> form of government. They unconstitutionally deprive persons of liberty and property. They sideline the constitutional, effective use of torts to control deprivations, for example to control deprivations due to <a href=\"https:\/\/cdn.mises.org\/Environmentalism%20and%20Economic%20Freedom%20The%20Case%20for%20Private%20Property%20Rights_2.pdf\" rel=\"noopener\" target=\"_blank\">pollution<\/a>.<\/li>\n<\/ul>\n<p>Oversight and investigations position Progressives to sound good so they\u2019ll be re-elected. This means that oversight and investigations deliver the exact opposite of relief.<\/p>\n<p>Relief is spelled R-E-P-E-A-L-S.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Legislative relief
